Getting Your Security Deposit Back: A Legal Guide

Step 1: The 30-Day Notice (Paper Trail is King)

The most common legal excuse a landlord uses to keep your money is claiming you didn't give them proper notice before vacating.

If your rent agreement states you must give a 30-day notice, you must provide it in writing exactly 30 days before you plan to leave. Verbal notices do not count. Send a WhatsApp message and take a screenshot.

Template: "Hello [Landlord Name], As per our rent agreement, I am giving my 30-day official notice to vacate Flat [Number] on [Date]. Please let me know a suitable time on my final day to do the handover and process my security deposit refund of ₹[Amount]. Thank you."

Step 2: Normal Wear & Tear vs. Actual Damage

Landlords will often try to charge you for things that are legally classified as "Normal Wear and Tear." By Delhi rental laws, you cannot be penalized for the natural aging of a property.

  • Normal Wear and Tear (Landlord Pays): Faded or slightly scuffed paint, loose door hinges from normal use, water scaling in the bathroom, or seelan (dampness/seepage) from the roof.
  • Actual Damage (You Pay): A shattered window pane, large holes drilled into the walls without permission, broken furniture (if provided by the landlord), or burn marks on the kitchen slab.

If they try to deduct ₹3,000 for "painting," refer back to your rent agreement. Unless you specifically agreed to a painting charge, they cannot legally deduct it.

Step 3: The Move-Out Inspection Strategy

Do not hand over the keys until the landlord inspects the flat in front of you.

On your last day, take a slow, continuous video on your phone walking through the entire empty, cleaned flat. Show the working lights, the clean bathroom, and the intact walls. This video is your ultimate insurance policy. If the landlord claims you broke something a week later, you have time-stamped proof that you left the flat in perfect condition.

Step 4: The "Electricity Adjustment" Trap

A common tactic is for the landlord to withhold the deposit, saying, "I will return it after the final electricity bill comes next month."

The Fix: Tughlakabad Extension flats run on sub-meters. On your final day, take a photo of the sub-meter. Multiply the units consumed that month by your agreed rate (e.g., ₹9/unit). Step 5: What to Do If They Still Refuse

If the landlord flat-out refuses to pay, becomes aggressive, or ghosts you, it is time to escalate.

  • The Firm Reminder: Send one final message stating that withholding a deposit without documented damage is a breach of contract and a civil offense.
  • Involve Your Broker: If you rented through a local agent, call them. A good broker relies on a clean reputation and will often pressure the landlord to return the money.
  • The Police Threat: You can call the local CR Park Police Station (112) for a "civil dispute." Often, just the mention of involving the police is enough to make a stubborn landlord open their Google Pay app.
