5 Rent Agreement Clauses Every Student Must Check

You’ve found the perfect 1 RK flat in Tughlakabad Extension. You’ve negotiated the rent, and the landlord hands you a 3-page document printed on ₹50 stamp paper. Most students just sign at the bottom without reading. This is a massive mistake.
In Delhi’s urban villages, the "Rent Agreement" (or Rent Deed) is your only legal shield. Landlords often use standard templates downloaded from the internet that heavily favor them, containing hidden traps that can cost you your entire security deposit later. Before you pick up that pen, you must verify these 5 critical clauses.
1. The "Lock-in Period" vs. "Notice Period"
These two terms are constantly confused by freshers, and landlords exploit this confusion.
- The Lock-in Period: This is the absolute minimum time you must pay rent, even if you leave early. In TKD Extension, a 6-month lock-in on an 11-month lease is standard. If you sign a 6-month lock-in and leave after 3 months, the landlord has the legal right to seize your security deposit.
- The Notice Period: This applies after the lock-in period is over. It dictates how many days in advance you must tell the landlord before you vacate (usually 30 days). If you leave without notice, they deduct a month's rent from your deposit.
The Fix: Never sign a flat with an 11-month lock-in. Demand a 6-month lock-in and a 1-month notice period. Ensure both are clearly defined in separate sentences.
2. The "Painting & Whitewash" Clause
This is the most common trick used to steal student security deposits in South Delhi.
Many standard agreements contain a sneaky line that reads: "One month's rent will be deducted for painting and whitewashing at the time of vacating the premises." This means if your deposit is ₹8,000, you are getting zero back when you leave, regardless of how clean you kept the flat.
The Fix: Cross that line out before signing. Replace it with: "The tenant is only liable for damages beyond normal wear and tear. No mandatory painting charges will be deducted." If the landlord refuses to change this, walk away.
3. The Sub-Meter & Utility Rate Lock
Never rely on a verbal agreement for electricity rates. If the landlord says, "Electricity is ₹9 per unit," but it isn't in the contract, they can arbitrarily raise it to ₹12 per unit next summer when you turn on your AC.

The Fix: The agreement should specify that Minor repairs (changing bulbs, fixing a leaking tap washer) are the tenant's responsibility. Major repairs (water motor replacement, structural seepage, main electrical wiring faults) are strictly the landlord's financial responsibility.
Scam Alert: "The Unregistered Lease"
In India, rental agreements for 12 months or more must be legally registered in court (which costs thousands in stamp duty). To avoid this, almost all student leases are strictly for 11 Months. If a landlord tries to make you sign a 2-year lease on ₹50 stamp paper, it is not legally valid and cannot protect you in a police dispute.
5. The "Guest & Timing" Restrictions
You are renting an independent flat to escape PG curfews. However, some conservative landlords will try to slip PG-style rules into the flat's rent agreement (e.g., "No guests allowed after 8 PM" or "Main gate locks at 10 PM").
The Fix: Read the "Code of Conduct" section carefully. Ensure there are no unreasonable time restrictions. It is fair for a landlord to include "No loud music after 11 PM," but completely unfair to include "No entry after 10 PM."
